“Your Content” refers to AI artwork, images, designs, or other materials that you upload, submit, or provide to the Website for use on Products.

Our Role: We operate as a platform connecting customers with Print Providers. We do not manufacture, print, or ship products ourselves. All production, printing, fulfillment, and shipping are handled by our Print Providers.

Service Scope: Our primary service is providing a platform where you can upload AI artwork that you own or have legal rights to use, apply it to products, and purchase those customized items. We may expand our services and offerings in the future without prior notice.

No Manufacturing: AiPrintOnDemand.com does not own inventory, operate printing facilities, or handle physical products. We are not responsible for the manufacturing quality, printing accuracy, or shipping logistics, except as outlined in Section J regarding issue resolution.

Third-Party Services: We may provide links to or integrate with third-party services, platforms, or websites. We do not control, endorse, or assume responsibility for any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

Service Availability: We strive to maintain continuous service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time for maintenance, updates, or other reasons.

F. Content Ownership and License

Your Ownership: You retain all ownership rights to Your Content, including any AI artwork you upload to our Website. By uploading Your Content, you represent and warrant that you own all rights to the content or have obtained all necessary permissions, licenses, and authorizations to use and display it.

Required Rights: You must have the legal right to use, reproduce, and display Your Content on products. This includes:

• Ownership of the AI-generated artwork
• Proper licensing from AI tools or platforms used to create the artwork
• Rights to any base images, references, or elements incorporated into the AI artwork
• Compliance with any terms of service from AI generation platforms you used

License to Us: By uploading Your Content to our Website, you grant AiPrintOnDemand.com a non-exclusive, worldwide, royalty-free license to use, reproduce, display, modify, and process Your Content solely for the purposes of:

• Producing and fulfilling your orders
• Displaying product previews and mockups
• Operating and improving our Services
• Marketing and promotional purposes (with attribution where appropriate)

Proof of Rights: We reserve the right to request proof of your ownership or licensing rights for any uploaded content. Failure to provide adequate proof may result in order cancellation or account suspension.

No AI Generation Services: AiPrintOnDemand.com does not provide AI art generation tools or services. You are responsible for creating or obtaining your AI artwork through other means before uploading it to our platform.

G. Prohibited Content and Conduct

You agree not to upload, display, or use Content that:

• Violates any intellectual property rights, including copyrights, trademarks, or patents
• Exploits, harms, or endangers minors in any way
• Contains hate speech or promotes discrimination, violence, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Is obscene, pornographic, or sexually explicit
• Promotes illegal activities, terrorism, or violence
• Contains personal information of others without their consent
• Is defamatory, fraudulent, or misleading
• Promotes self-harm or dangerous activities
• Infringes upon privacy rights or contains confidential information
• Violates any applicable laws or regulations

You further agree not to:

• Use the Website for any illegal purpose or in violation of any laws

Website Content: All content on our Website, including text, graphics, logos, images, software, and design elements, is owned by or licensed to us and is protected by copyright and intellectual property laws.

Copyright Infringement: We respect intellectual property rights. If you believe that content on our Website infringes your copyright or other intellectual property rights, please contact us immediately with detailed information about the alleged infringement. We will investigate and take appropriate action, which may include removing the content and terminating the account of repeat infringers.

AI Artwork Responsibility: You acknowledge that AI-generated artwork may inadvertently incorporate elements from training data that could potentially infringe on third-party rights. You assume all responsibility and liability for ensuring your AI artwork does not violate any intellectual property rights. We are not responsible for any copyright or intellectual property disputes arising from Your Content.

I. Pricing and Payment

Product Pricing: All prices displayed on our Website are in U.S. Dollars (USD) unless otherwise specified. Prices include the base product cost and customization but exclude shipping, taxes, and any applicable fees unless explicitly stated.

Payment Required: Payment must be received in full before any order is processed or sent to production. We accept major credit cards, debit cards, and other payment methods as displayed at checkout.

Pricing Changes: We reserve the right to modify product prices at any time without prior notice. Price changes will not affect orders already placed and paid for.

Taxes: You are responsible for all applicable taxes related to your purchase, including sales tax, use tax, VAT, or other taxes based on your location. Where required by law, we will collect and remit applicable taxes on your behalf.

Payment Processing: Payments are processed through secure third-party payment processors. We do not store complete credit card information on our servers.

Failed Payments: If a payment fails or is declined, your order will not be processed. We reserve the right to cancel orders with failed payments.

J. Orders and Production

Order Confirmation: You will receive an email confirmation once your order is successfully placed. This confirmation does not constitute our acceptance of your order; acceptance occurs when the order is sent to production.

Production Time: Production times are estimates based on information provided by our Print Providers and are not guaranteed. Actual production and delivery times may vary.

Order Modifications: Once an order is submitted and paid for, it cannot be modified or canceled unless we determine it has not yet entered production. We will make reasonable efforts to accommodate change requests but cannot guarantee modifications will be possible.

No Refunds on Completed Orders: All products are custom-made to order based on Your Content. Once an order enters production, it is non-refundable except as provided in Section K regarding defective products.

Quality Control: Orders may undergo automated quality checks. If we identify potential issues with your artwork (such as low resolution, improper dimensions, or design problems), we will notify you via email. If we do not receive a response within 7 days, or if you choose to proceed despite warnings, the order will be produced and will not be eligible for refunds or replacements due to those issues.

K. Shipping and Delivery

Shipping Responsibility: All shipping and delivery are handled by our Print Providers and their designated carriers. Shipping times are estimates and are not guaranteed.

Shipping Address: You are responsible for providing an accurate and complete shipping address. We are not responsible for orders shipped to incorrect addresses provided by you. Reshipping to a corrected address may incur additional charges.

Delivery Issues: If an order has not been delivered within 30 days for domestic U.S. orders or 45 days for international orders, please contact us immediately. We will investigate and work with the Print Provider to resolve the issue.

Lost or Damaged Shipments: If an order is lost in transit or arrives damaged, please contact us within 30 days of the expected delivery date with photographic evidence. We will investigate and may provide a replacement or refund at our discretion.

Tracking Delivered Orders: If tracking information indicates an order was delivered but you claim non-receipt, we reserve the right to investigate before providing a replacement or refund. We may deny claims if evidence supports successful delivery.

Shipping Delays: We are not responsible for delays caused by shipping carriers, customs processing, weather, or other factors beyond our control. No refunds will be issued for shipping delays unless the order is determined to be lost.

L. Returns, Refunds, and Replacements

Custom Products: All products are custom-made based on Your Content and are therefore non-returnable and non-refundable except for defective products or errors caused by us or our Print Providers.

Defective Products: If you receive a product that is defective, damaged, or significantly different from what was ordered due to printing errors or manufacturing defects, please contact us within 30 days of delivery with:

• Your order number
• Detailed description of the issue
• Clear photographs showing the defect or damage

Investigation Process: All claims will be investigated. We will work with our Print Providers to determine if the product qualifies for a replacement or refund. Our decision is final.

Replacement or Refund: If we determine a product is defective, we will offer, at our discretion:

• A replacement product at no additional charge
• A refund of the product cost (excluding shipping)
• Store credit for future purchases

Non-Qualifying Issues: The following do not qualify for refunds or replacements:

• Customer errors (wrong size, color, or design selected)
• Issues related to artwork provided by you (low resolution, incorrect colors, design flaws)
• Minor variations in color due to different monitor displays or printing processes
• Shipping address errors provided by you
• Changed mind or buyer’s remorse
• Shipping delays

Refund Processing: Approved refunds will be processed to the original payment method within 7-10 business days after approval.

M. Limitation of Liability

AS-IS SERVICE: THE WEBSITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

NO LIABILITY FOR DAMAGES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIPRINTONDEMAND.COM, ITS OWNERS, OPERATORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF OPPORTUNITY, ARISING FROM:

• Your use or inability to use the Website or Services
• Any products purchased through the Website
• Unauthorized access to your account or information
• Errors, mistakes, or inaccuracies of content
• Any interruption or cessation of services
• Any third-party conduct or content on the Website
• Any interaction with Print Providers

MAXIMUM LIABILITY: OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE WEBSITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Third-Party Print Providers: We are not liable for the actions, errors, or omissions of our Print Providers. While we work with reputable partners, the quality, accuracy, and timeliness of production and shipping are ultimately the responsibility of the Print Provider.

Jurisdictional Variations: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

N. Indemnification

You agree to indemnify, defend, and hold harmless AiPrintOnDemand.com, its owners, operators, employees, contractors, and Print Providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

• Your violation of these Terms of Service
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including intellectual property rights, privacy rights, or publicity rights
• Your Content, including any claims that Your Content infringes on third-party rights
• Any AI artwork you upload and its creation or use
• Your interactions with other users or customers
• Any false, misleading, or inaccurate information you provide

This indemnification obligation survives the termination of these Terms of Service and your use of the Website.

O. Dispute Resolution and Governing Law

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.

Informal Resolution: Before initiating any formal legal proceedings, you agree to first contact us to attempt to resolve any dispute informally. Please send a detailed description of the dispute to our support team, and we will work in good faith to resolve the matter.

Jurisdiction and Venue: If informal resolution is unsuccessful, you agree that any legal action or proceeding arising from or related to these Terms of Service or your use of the Website shall be brought exclusively in the state or federal courts located in Arizona, and you consent to the personal jurisdiction of such courts.

Arbitration: For disputes that cannot be resolved informally, either party may elect binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Arizona unless both parties agree otherwise.

No Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Time Limitation: Any claim or dispute must be brought within one (1) year from the date the cause of action arose, or it will be permanently barred.
